Europ Assistance
This document, mod. TO8405, is an extract from the General Policy Conditions
signed by the Tour Operators in favour of the insured parties, and is
released by the Contractor to inform of the conditions agreed upon with
Europ Assistance. The enforceability of this document is subordinated to the
validity of the Policy.

Information for the client on the processing of personal data
Pursuant to article 13 of Italian Legislative Decree No. 196 of 30 June 2003
regarding the protection of personal data (Italian Corporation), we inform that:
1.
your personal data (the "Data”) shall be treated by Europ Assistance Italia
S.p.A. using paper, electronic and/or automated means, for purposes regarding:
a) the handling and
execution of the obligations regarding the insurance Policy;
b) fulfilment of
obligations of law, regulations or community standards (against money laundering
for example) and/or the regulations of public institutes.
2. the processing of
data is:
a)
necessary for executing and managing the insurance policy (1.a);
b)
obligatory according to law, regulations or community standards and/or
the regulations of public institutes (1.b).
3. the Data can be
communicated to the following bodies as independent Holders:
a) particular subjects,
entrusted by Europ Assistance Italia S.p.A. to supply instrumental services or
those services necessary for carrying out the obligations of the insurance
Policy in Italy and abroad, such as – for example – subjects in charge of
handling the archives and data processing, credit institutes, experts, legal
medical staff;
b) associated
organisations (Ania) and consortiums of the insurance sector, Isvap, legal
authorities as well as all the other subjects to which communication is
necessary for obtaining the purposes indicated in point 1b;
c) assistance staff,
companies controlled by or connected to Europ Assistance Italia S.p.A. or
entrusted by same to fulfil the purposes indicated in points 1.a and 1.b in
in addition, the supplied Data can be made known to head or responsible
employees and collaborators.
The Data cannot be spread.

The data processor is Europ Assistance Italia S.p.A. You can request the
list of data processors, exercise the rights indicated in article 7 of the
Italian Privacy Code and, in particular, obtain confirmation of the existence of
data relative to yourself from the data processor, communicate same data and
request the logic and purposes of the processing, as well as cancel, update and
block same data, and oppose treatment for legitimate reasons in writing to:
Europ Assistance Italia S.p.A. – Piazza Trento, 8 – 20135 Milan – Data
Protection Office.
Definitions
INSURED:
the physical person/people residing in one of the European Union Countries
and/or
DAMAGE:
any damage suffered by the luggage while the ship is sailing or while the
aircraft is flying
LUGGAGE:
the suitcase/s, trunk/s and personal objects contained in them that the Insured
party takes on the journey.
OPERATIVE CENTRE:
the structure of Europ Assistance Service S.p.A., Piazza Trento no. 8 – 20135
CONTRACTOR:
the tour operator, with registered and fiscal office in Italy that signs the
policy in favour of third parties and takes on the relative duties.
STARTING DATE AND DURATION:
the duration of the Insurance for each individual Insured party is equal to the
duration of the journey and/or rental communicated by the Contractor to Europ
Assistance. The maximum duration of the cover for each period of continuous
permanence abroad during the validity period of the Insurance is 60 consecutive
days. The “Journey and/or rental cancellation” guarantee is valid from the day
of registration for the journey/rental and lasts until the starting day of the
journey/rental itself.
TERRITORIAL EXTENSION:
the country or group of countries where the journey is to be made, regularly
communicated to Europ Assistance, and where the Insured party has suffered the
damage that originated the right to the service/guarantee. The territorial
extension for Insured parties residing in the European Union or in Switzerland
can be:

For Insured parties residing in non-European Union countries:

The services and guarantees are valid:
For insured parties residing in the European Union or in

in the case of journeys by airplane, train, bus or ship, from the departure
station (airport, railway, etc. of the organised journey) until the end of the
journey as organised by the contractor;
·
in the case of journeys by car or other means not indicated in the previous
point,
For Insured parties residing in non-European Union countries:
·
in the case of journeys by airplane, train, coach or ship, from the arrival date
in one of the European Union countries or Switzerland until the departure date
from one of same countries when the journey ends;
·
in the case of journeys by car or other means not indicated in the previous
point, upon crossing of the border and Customs of one of the European Union
countries or

THEFT:
a crime, as indicated in art. 624 of the Italian Penal Code, perpetrated by
anyone who takes possession of a mobile thing belonging to someone else and
removes it from them, in order to make profit, either personal or for others.
GUARANTEE:
insurance that does not fall within the assistance insurance for which, in case
of accident, Europ Assistance reimburses the damage suffered by the Insured
party.
ACCIDENT:
a violent and external accident caused by chance that produces objectively
ascertainable body injury.
CARE INSTITUTE:
a public hospital, clinic or nursing home, both operating within the National
Health Service and private, regularly authorised to hospitalize ill people;
spas, convalescent homes and day homes are excluded from the insurance.
ILLNESS:
any alteration in the health of a person that does not depend on accidents.
UNEXPECTED ILLNESS:
illness with an acute source, that the Insured party was not familiar with and
which is not a manifestation, even if unexpected, of a previous illness known by
the Insured party.
PRE-EXISTING ILLNESS:
an illness that is the expression or the direct result of pathological
situations, chronic or pre-existing, that were known when the guarantee started.
MAXIMUM INDEMNITY:
the maximum amount established in the policy and up to which Europ Assistance
issues sums for the guarantee and/or the expected service.
SERVICE:
assistance that Europ Assistance gives to the Insured party through the
Operative Centre in a moment of need.
ROBBERY:
a crime, as indicated in art. 628 of the Italian Penal Code, carried out by
anyone who uses violence or menace to take possession of mobile things belonging
to someone else and removes it from them to procure unjust profit, both personal
and for others.
HOSPITALIZATION:
an overnight or longer lasting stay in a care institute.
BAG-SNATCHING:
a crime, as indicated in articles 624 and 625 No. 4 of the Italian Penal Code,
carried out by anyone who takes possession of mobile things belonging to someone
else, removing same thing/s with dexterity, in other words snatching the thing
from the hand of or from behind the person, in order to procure unjust profit,
both personal and for others.
DAMAGE:
a single fact or occurrence that can arise during policy validity and which
determines the request for assistance, reimbursement or compensation by the
Insured party.
UNINSURED PERCENTAGE:
the percentage of the amount of the damage that remains obligatorily at the cost
of the Insured party, with a minimum expressed as an absolute value.
JOURNEY:
For insured parties residing in the European Union or in
·
in the case of journeys by airplane, train, bus or ship, from the departure
station (airport, railway, etc. of the package tour) until the end of the
journey as organised by the contractor;
·
in the case of journeys by car or other means not indicated in the previous
point,
For Insured parties residing in non-European Union countries:
·
in the case of journeys by airplane, train, coach or ship, from the arrival date
in one of the European Union countries or Switzerland until the departure date
from one of same countries when the journey ends;
·
in the case of journeys by car or other means not indicated in the previous
point, upon crossing of the border and Customs of one of the European Union
countries or
Limitations
Only one of each type of VIAGGI TOUR OPERATOR services are supplied during the
journey. The “Medical Expenses Reimbursement Insurance” and “Luggage and
Personal Effects Insurance” guarantees can be requested even several times
during the journey, it being understood that the total amount of the refund paid
does not exceed the maximum indemnities indicated.
The VIAGGI TOUR OPERATOR services and guarantees will not be given in the
following cases:
·
nervous and mental illnesses, for illnesses depending on pregnancy beyond the 26th
week and from puerperium;
·
illnesses that are the expression or direct result of pathological situations,
both chronic and pre-existing at the start of the journey;
·
illnesses and accidents resulting and deriving from the abuse of alcohol or
psychotropic drugs, as well as from the non therapeutic use of drugs and
hallucinogens;
·
accidents deriving from the following activities: alpinism with rock climbing or
access to glaciers, trampoline jumps with skis or water skis, the driving and
use of bobsleighs, air sports in general, reckless acts as well as all accidents
suffered as a result of sports activities carried out professionally;
·
the removal and/or transplant of organs.
Assistance Insurance – Services

MEDICAL ADVICE
Should the Insured party require his/her state of health to be evaluated, he/she
can contact the Operative Centre doctors and request a telephone consultation.

SENDING OF A DOCTOR OR AN AMBULANCE IN
Should it be necessary, subsequent to Medical Advice (see service 1), for the
Insured party to undergo a medical visit during the journey, the Operative
Centre shall send, at Europ Assitance’s expense, one of their doctors working
with Europ Assistance to the place of the event. Should it be impossible for the
doctor to intervene personally, the Operative Centre shall organise transferral
of the Insured party by ambulance to the nearest and most suitable medical
centre. The service is supplied from 8.00 pm to 8.00 am Monday to Friday, and 24
hours a day on Saturday, Sunday and holidays.

INDICATION OF A SPECIALIST DOCTOR ABROAD
Should it be necessary, following Medical Advice (see service 1), for the
Insured party to see a specialist during the journey, the Operative Centre
shall, in compatibility with local availability, indicate the name of a
specialist doctor in the area nearest the place where the Insured party is.

RETURN FOR HEALTH REASONS
Should sudden accidents or illnesses make it necessary, in the opinion of the
Operative Centre doctors and in agreement with the general practitioner on site,
for the Insurance party to be transported to an equipped care centre, the
Operative Centre shall, at Europ Assitance’s expense, organise the return with
the means and in the times held as being most suitable by the Operative Centre
doctors, following their consultation with the general practitioner on site.
This means can be:
·
a medical airplane;
·
an airliner in economy class, if necessary in stretchers;
·
a train in first class and, if necessary in the sleeping car;
·
an ambulance (without limits of distance).
The Operative Centre shall use the medical airplane only if the injury occurs in
European countries and those of the
Transport shall be fully organised by the Operative Centre and shall include
medical or nursing assistance during the journey, should the Operative Centre
doctors feel it necessary.
Europ Assistance shall have the faculty to request the return journey ticket
that is not used by the Insured party. Should the Insured party need to be
transferred to the nearest equipped Emergency Room or Care institute, or
transferred to a care centre that is suitable for treating the pathology because
hospitalized in an unsuitable local structure, the Operative Centre shall
organise transferral, using the means and in the times held as being most
suitable by the Operative Centre doctors following consultation with a general
practitioner on site. In this case Europ Assistance shall pay the relative costs
up to a maximum of Euro 7,500.00 at its own charge.
Should the Insured party die, the Operative Centre shall organise transport of
the body to the burying place in the country of residence. Europ Assistance
shall pay the costs for transporting the body up to a maximum of Euro 5,000.00
per Insured party at its own charge; if this service costs more Europ Assistance
shall intervene immediately, after having received suitable guarantees regarding
payment of the excess amount in
The following are excluded from the service:
·
the injuries or wound which, in the judgement of the Operative Centre doctors,
can be cured on site or that do not stop the Insured party from continuing with
his/her journey;
·
infective illnesses, should transportation violate national or international
health regulations;
·
costs for the funeral service and those for the search for people and/or
possible body recovery;
·
all the cases in which the Insured party or relatives of same sign for voluntary
discharge, against the opinion of the doctors of the structure in which the
Insured party is being hospitalized.

RETURNING WITH AN INSURED RELATIVE
Should the doctors of the Operative Centre, when organising the service of
Return for Health Reasons (see service 4), feel that it is not necessary for the
Insured party to receive health assistance during the journey, and an insured
relative would like to accompany same Insured party to the place of cure or to
his/her residence, the Operative Centre shall arrange for the relative to
accompany the Insured party with the same means. Europ Assistance shall have the
faculty to request that the insured relative return their unused journey ticket.
The following are excluded from the service:
·
The costs of the stay of the relative.

RETURN OF OTHER INSURED PARTIES
Should, subsequently to the Return for health reasons service (see service 4)
the insured people travelling with the Insured party not be objectively able to
return to their residence with the means initially programmed and/or used, the
Operative Centre shall supply them with a first class railway ticket or an
economy class airway ticket. Europ Assistance shall have the faculty to request
them to return any unused journey tickets. Europ Assistance shall pay for the
cost of the tickets up to a maximum amount of 200,000 Euros per insured person.

THE JOURNEY OF A RELATIVE
Should the Insured party be hospitalized for a period of more than 7 days, the
Operative Centre shall supply, at the charge of Europ Assistance, a first class
return railway ticket or an economy class return airway ticket to allow a
relative that lives with the Insured party to reach the hospitalised person.
The following are excluded from the service:
·
the costs of the stay of the relative.
8
ACCOMPANIMENT OF MINORS
Should the travelling Insured party, following an accident, illness or as a
result of acts of God, find it impossible to care for insured parties of 15
years or younger travelling with them, the Operative Centre shall supply, with
cost at the charge of Europ Assistance, a return first class railway ticket or a
return economy class airway ticket to allow a relative to reach the minor/s,
take care of him/her/them and take him/her/them to their home.
The following are excluded from the service:
·
the costs of the stay of the relative.

RETURN OF THE CONVALESCENT INSURED PARTY
Should the Insured party, as a result of hospitalization in a care institute,
not be able to return to his/her home using the means initially programmed, the
Operative Centre shall supply same party, with costs at the charge of Europ
Assistance, a first class railway ticket or an economy class plane ticket.

STAY EXTENSION
Should written medical prescriptions certify that the health conditions of the
Insured party do not allow him/her to undertake the journey to return to his/her
home in one of the European Union Countries and/or
The following are excluded from the service:
·
the hotel costs other than those for a room and breakfast.

INFORMATION ON CORRESPONDING OVERSEAS MEDICATIONS
Should the Insured party, when abroad, require information on special
medications regularly registered in

INTERPRETER AVAILABLE ABROAD
Should the Insured party, when abroad, be hospitalized and have difficulty in
communicating with the doctors because not familiar with the local language, the
Operative Centre shall send an interpreter to the place.
Maximum
The interpreting costs shall be at the charge of Europ Assistance for a maximum
of 8 working hours.

ADVANCED FIRST NEED COSTS
Should the Insured party maintain unexpected costs and find it impossible to pay
them immediately and directly because of illness, injury, theft, burglary,
bag-snatching or lost luggage, the Operative Centre shall pay, as an advance on
behalf of the Insured party, the amount of the invoices up to a maximum total of
5,000.00 Euros. Should the amount exceed the total amount of 150.00 Euros, the
loan shall become operative from the moment in which Europ Assistance receives
suitable bank guarantees in
The following are excluded from the service:
·
the transfer of currency abroad that violates current laws in
·
those cases in which the Insured party cannot supply suitable return guarantees
to Europ Assistance in
·
In the countries in which Branches or Europ Assistance Correspondents do not
exist.
Obligations of the Insured party:
The Insured party must communicate the reason for the request, the amount
necessary, his/her address and reference indications that allow Europ Assistance
to verify the terms of the guarantee for return of the anticipated amount. The
Insured party must reimburse the advanced amount within one month from the date
of the advance itself, penalty being payment of interest at the current legal
rate in addition to the anticipated sum.

EARLY RETURN
Should the Insured party, while travelling, have to return to his/her own
residence before the date programmed and with a means different from that
initially programmed, because of death, as indicated by the date on the death
certificate released by the Registry Office, or hospitalisation, with imminent
danger to life, of one of the following relatives: wife/husband/partner more
uxorio, son/daughter, brother, sister, parent, mother/father-in-law,
son/daughter-in-law, the Operative Centre shall supply them, at Europ
Assitance’s expense, a first class railway ticket or an economy class airway
ticket, so that same can reach the place where the body is to be buried or where
the person is being hospitalized. Should the Insured party travel with a minor,
the Operative Centre shall organise the return of both as long as insured. If it
is impossible for the Insured party to use his/her vehicle for returning early,
the Operative Centre shall make available an additional ticket for subsequent
vehicle recovery.
The following are excluded from the service:
·
those cases in which the Insured party cannot supply the Operative Centre with
suitable information on the reasons for the request for early return.
Obligations of the Insured party:
The Insured party must supply, within 15 days from the accident, the original
version of the documentation proving the cause of the return.

ADVANCE FOR BAIL ABROAD
Should the Insured party be arrested or find him/herself in a predicament which
could cause his/her arrest and were consequently to pay bail to the foreign
authorities, and should him/her not be able to pay directly and immediately, the
Operative Centre shall pay the bail on site, as an advance on behalf of the
Insured party.
Europ Assistance shall anticipate payment of bail up to a maximum amount of
5,000.00 Euros. The amount of the bail paid by Europ Assistance in advance
cannot for any reason exceed the amount of 5,000.00 Euros. The loan shall become
operative from the moment in which Europ Assistance receives suitable bank
guarantees in
The following are excluded from the service:
·
the transfer of currency abroad that violates current laws on the matter in
·
those cases in which the Insured party cannot supply Europ Assistance with
suitable return guarantees in
·
in countries where there are no Europ Assistance Branches or Correspondents.
Obligations of the Insured party:
The Insured party must communicate the reason for the request, the amount
necessary, his/her address and reference indications that allow Europ Assistance
to verify the terms of the guarantee for return of the anticipated amount. The
Insured party must reimburse the advanced amount within one month from the date
of the advance itself, penalty being payment of interest at the current legal
rate in addition to the anticipated sum.

RECOMMENDATION OF A LAWYER ABROAD
Should the Insured party be arrested or find him/herself in a predicament which
could cause his/her arrest and require legal assistance, the Operative Centre
shall recommend the name of a lawyer who is as close as possible to the place in
which the Insured party finds him/herself, in compliance with local regulations.
Exclusions.
All costs deriving from the lawyer’s intervention shall be at the total cost of
the Insured party. The service is not operative in countries where Europ
Assistance Branches or Correspondents do not exist.

SENDING URGENT MESSAGES
Should it be impossible for the Insured party to send urgent messages to people
living in
Exclusions:
The Operative Centre is not responsible for the transmitted messages.
MEDICAL EXPENSES REIMBURSEMENT INSURANCE
Should the Insured party, following unexpected illness or injury, have to pay
medical/pharmaceutical/hospital costs for treatments or surgeries that are
urgent and cannot be postponed, received on site during the journey and within
the guarantee period, Europ Assistance shall reimburse such costs on the basis
of the maximum indemnity provided for in the Policy and indicated in the table
at the bottom of the page. The additional costs for care received upon return to
the residence are only covered by the guarantee if resulting from accidents, as
long as same care is given within 45 days subsequent to the injury itself.
Maximum indemnity
Europ Assistance shall, at its own expense, pay for medical and pharmaceutical
costs, even in case of hospitalization in a care institute or in a place
equipped for Emergencies. Same costs shall be paid directly on site by the
Operative Centre and/or as a reimbursement, up to the maximum indemnity amount
provided for in the Policy and indicated in the table at the bottom of the page
for each Insured party and for the duration/destination of the journey. The
reimbursements shall be made with a fixed and absolute sum excess per injury and
per Insured party of 35.00 Euros.
The following are included in the maximum indemnities:
·
the rates for the stay in the hospital or Institute prescribed by the doctor up
to Euro 200.00 per day for each Insured party;
·
the costs for urgent dental treatment, only following accidents, up to Euro
100.00 per Insured party;
·
the costs for repairing prostheses, only following accidents, up to Euro 100.00
per Insured party.
The following are excluded from the guarantee:
·
all costs incurred by the Insured party should the recovery or Emergency service
not have been declared to Europ Assistance, either directly or indirectly by
third parties;
·
the costs for treating or eliminating physical defects or congenital
malformations, for applications of an aesthetic nature, for nursing,
physiotherapy, thermal and slimming treatment, for dental care (excluding those
specified above following accident).
·
the costs for purchasing and repairing spectacles, contact lenses, the costs for
orthopaedic and/or prosthetic apparati (excluding those specified above
following an accident);
·
check-ups in
·
the transport and/or transfer costs to care institutes and/or the staying place
of the Insured party.
Obligations of the Insured party:
In case of accident, the Insured party must send, within and not beyond sixty
days from accident occurrence, a written statement addressed to: Europ
Assistance Italia S.p.A. – Piazza Trento, 8 – 20135
·
name, address and telephone number;
·
Europ Assistance card number or copy of same held by the Insured party;
·
emergency certificate drawn up on the place of the accident giving the
pathology, or the medical diagnosis that certifies the type of injury and how it
happened;
·
in case of hospitalization, an authenticated copy of the case history;
·
original copies of invoices, receipts or fiscal receipts for the costs incurred,
complete with fiscal data (VAT No. or Fiscal Code) of the issuing bodies and the
holder of the receipts themselves;
·
medical prescription for the possible purchase of medications with the original
receipts of the medications purchased.
Criteria for damage liquidation:
Following an evaluation of the documentation received, the Accident Liquidation
Office of Europ Assistance shall liquidate the damage and the relative payment
net of the forecasted exemptions.
Luggage and personal effects insurance
Should the Insured party undergo material and immediate damage because of theft,
housebreaking, robbery, bag-snatching, loss, breakage of his/her own luggage
and/or personal effects, including the clothes worn, that he/she had at the
start of his/her journey, Europ Assistance shall reimburse the value of same up
to the maximum amount indicated in the Policy and given in the table at the
bottom of the page. For journeys made by plane, train, bus or ship, the
guarantee is valid:
·
for those insured parties who reside in the European Union countries and/or
·
for those insured parties who reside in non-European Union countries, from the
arrival date in one of the European Union countries and/or Switzerland until the
departure date from one of same countries at the end of the journey.
Maximum indemnity:
The guarantee is given with territorial extension and up to the sum indicated in
the Policy and given in the table at the foot of the page, for each insured
party and for the duration of the journey. Excluding the maximum amounts
indicated previously, the maximum indemnity for each object, including bags,
suitcases and haversacks, cannot exceed the amount of Euros 150.00.
Photocineoptic equipment (cameras, video cameras, binoculars, flashlights,
lenses, batteries, bags, etc.) are considered a single object. Should Identity
cards, Passports and Driving licences be stolen, snatched or lost, a total
maximum amount of 50.00 Euros shall be reimbursed, in addition to the previously
indicated maximum indemnity, to cover the costs of replacement but only if
certified by a cost receipt.
Uninsured percentage:
Damages to photocineoptic apparati and photosensitive material, radios,
televisions, recorders, any other electronic apparatus, musical instrument,
personal safety weapons and/or weapons for hunting, underwater equipment,
spectacles or sunglasses are covered inclusively for a sum up to 50% of the sum
insured.
Damage to the following is covered inclusively for a sum up to 30% of the
insured sum:
·
cosmetics, medications, medical products;
·
jewels, precious stones, pearls, watches, gold/silver/platinum objects;
·
furs and other precious objects. The guarantee is only operative if the goods
are worn or given in deposit in the hotel.
The forecasted sum is in addition reduced by 50% for damage deriving from:
·
forgetfulness, neglect or loss by the Insured party;
·
theft with breakage of the luggage held inside the vehicle regularly locked, not
visible from outside;
·
theft of the whole vehicle;
·
theft of objects contained in the tent, as long as positioned in a regularly
equipped and authorised camping area.
The following are excluded from the guarantee:
·
money, cheques, stamps, tickets and travel documents, souvenirs, coins, art
objects, collections, sample lines, catalogues, goods, helmets, professional
equipment, documents other than Identity cards, Passports and Driving licences;
·
all damage verified during the journeys made on motor vehicles of any
horsepower;
·
damage deriving from fraud or serious fault of the Insured party and those
caused to sports equipment during their use;
·
goods other than clothing, for example watches, spectacles and sunglasses, that
have been delivered, even together with clothes, to a transport company,
including the air carrier;
·
theft of luggage contained inside a vehicle that is not regularly locked;
·
theft of luggage contained inside a vehicle and which is visible externally;
·
theft of luggage on board a vehicle that was not kept in a guarded garage from
8.00 pm to 7.00 am;
·
the fixed and service accessories of the vehicle itself (including extractable
sound equipment);
Obligations of the Insured party:
In case of damage, the Insured party must send, subsequent to telephone contact
with the Operative Centre and within and no later than ten days from damage
verification, a written statement addressed to: Europ Assistance Italia S.p.A. –
Piazza Trento, 8 – 20135
·
name, surname, address, telephone number;
·
Europ Assistance care number or copy of same card if in the possession of the
Insured party;
·
copy of the travel tickets or the stay details;
·
authenticated copy of the report with the stamp of the Police authority of the
place where the fact occurred;
·
the circumstances of what occurred;
·
the list of lost or stolen objects, their value and the date of purchase;
·
the names of the insured parties who suffered the damage;
·
copy of the letter of complaint presented to the hotel owner or carrier who may
have been responsible;
·
justifications of the document replacement costs, if any;
·
original copies of all invoices, receipts or fiscal receipts, complete with
fiscal data (VAT No. or Fiscal Code) of the issuers and the owners of the
receipts themselves, proving the value of the goods that were damaged or stolen
and their purchase date;
·
invoice of repair or declaration of impossibility to repair regarding the
damaged or stolen goods, written on headed paper by an agent or a sector
specialist.
The following must be attached when requesting reimbursement only in the case of
the whole set of luggage or part of it that was given to the air carrier not
being delivered:
·
copy of the Luggage Irregularity Report made immediately to the airport office
that is specifically in charge of complaints for lost luggage;
·
copy of the letter of complaint sent to the air carrier with the request for
reimbursement and the reply of the carrier.
Criteria for damage liquidation:
Damage shall be liquidated, as an integration of what was reimbursed by the air
carrier or by the responsible hotel owner and up to the limits of the insured
sum, on the basis of the commercial value that the guaranteed goods had at the
moment of the damage, according to what results from the documentation given to
Europ Assistance. In case of objects purchased no later than three months before
the damage was caused, reimbursement shall be made on the basis of the purchase
value, if proved by the relative documentation. In the case of damage the cost
of the repair shall be reimbursed upon presentation of the invoice. In no case
shall the sentimental value be considered.
COSTS FOR DELAYED DELIVERY OF LUGGAGE
Europ Assistance shall reimburse unexpected costs incurred by the Insured party
for the purchase of toiletries and/or necessary clothing as a result of luggage
that was delivered with a delay of more than 12 hours relative to regularly
confirmed airline flights.
Maximum indemnity:
Reimbursement shall be made up to the maximum sum of Euro 100.00 for damage and
for the duration of the journey.
The following are excluded from the guarantee:
The case of delayed delivery of luggage occurring in the airport of the city in
which the Insured party resides;
All the costs paid by the Insured party after receipt of the luggage.
Obligations of the Insured party:
In the case of damage, the Insured party must send a written statement addressed
to: Europ Assistance Italia S.p.A. – Piazza Trento, 8 – 20135
·
name, surname, address, telephone number;
·
Europ Assistance card number or a copy of it if in the possession of the Insured
person;
·
a declaration from the airport management company or from the air carrier that
confirms the 12-hour delay in luggage delivery and the time of actual delivery;
·
original copies of all invoices, receipts or fiscal receipts, complete with
fiscal data (VAT No. or fiscal code) of the issuer and the owners of the
receipts themselves, proving the value of the purchased goods;
·
a copy of the letter of complaint sent to the air carrier with the request for
reimbursement and the reply of the carrier.
Journey and/or location cancellation insurance
Should the Insured party be charged a penalty by the travel agency or
organisation because he/she modified or cancelled as a result of one of the
causes indicated below and before the start of the booked journey or rental,
Europ Assistance shall reimburse the amount of same penalty for cancellation or
modification (excluding the enrolment fee) as long as the causes for
cancellation were involuntary and unpredictable at the moment of booking.
The guarantee shall be supplied exclusively following cancellation or
modifications because of:
a)
Illness, accidents (for which the impossibility of participating in the journey
is clinically documented) or in case of death;
·
of the Insured party;
·
of the wife/husband/partner more uxoria, of a son/daughter, brother/sister,
parent or in-law, son or daughter-in-law, or of the Associate/joint owner of the
company or associated studio. If same people are not enlisted for the journey
together with and at the same time as the Insured party, in the case of serious
illness or injury, the Insured party must demonstrate that the presence of same
person is necessary;
·
of possible companions, as long as Insured, enlisted for the journey together
with and at the same time as the Insured party themselves.
Starting date and validity:
The guarantee begins on the journey and/or rental booking date and lasts until
the start of the journey and/or rental, the term start of the journey indicating
the moment in which the Insured party should present him/herself at the
departure station.
Maximum indemnity:
The penalty debited to the Insured party is reimbursed in full (excluding the
enrolment fee) up to the maximum amount indicated in the contract by the Journey
organisation and/or indicated in the table at the foot of the page for each
Insured party and for the journey destination and/or given by the Tour Operator
in their catalogues. Such indemnity amount cannot exceed the sum of Euro 200.00
for each Insured party.
Regarding what is indicated at letter a), in case of waiver of several Insured
parties booked for the journey together and at the same time, reimbursement
shall be made up to an amount equal to the sum of the maximum indemnities
insured for each Insured party but at a total maximum figure of Euro 600.00 for
each damage.
Exclusions:
1 cases of waiver
caused by:
·
injury, illness or death of people aged 80 years and above;
·
injury, illness or death verified before the moment of booking or illness
existing before the booking;
·
pregnancy or pathological situations resulting from it;
·
no communication of the address where the persons indicated in point a) can be
found;
·
nervous, mental, neuropsychiatric and psychosomatic illnesses;
·
work reasons different from those guaranteed;
·
theft, burglary, loss of identity and/or travel documents;
2 those cases in
which the Insured party did not communicate to the travel organisation or
agency, or even directly to Europ Assistance, the formal waiver of the booked
journey and/or location, within five calendar days from when the cause of the
waiver itself was verified;
3 those cases in
which the Insured party did not send communication before the journey or
location starting date if the term of five days indicated in point 2) falls
after the journey and/or location starting date
Obligations of the Insured party:
In case of modifications to and/or forced waiver of the journey or location, the
Insured party must send by telegram or fax to 0039.02.58384575 within the terms
indicated in “Exclusions”, a written statement addressed to Damage Liquidation
Office (Journey Cancellation) – Europ Assistance Italia S.p.A. – Piazza Trento,
8 – 20135 Milan, indicating:
·
name, surname, address, telephone number;
·
Europ Assistance card number;
·
the cause of cancellation or modification;
·
a contact address for the Insured party;
If the journey or location was waivered and/or modified because of the illness
of and/or injury to one of the people indicated in point a), the waiver must
include:
·
the address where these people can be contacted;
·
the type of pathology;
·
when the pathology started and finished
Within 15 days from waiver as indicated above, the Insured party must in
addition present the following documents to Europ Assistance Italia S.p.A.:
·
if in the possession of the Insured party, a copy of the Europ Assistance Card;
·
a medical certificate confirming the date of the injury or when the illness
started, the specific diagnosis and the days of prognosis;
·
in case of hospitalization, an authenticated copy of the case history;
·
in case of death, the death certificate;
·
booking form for the journey or a similar document;
·
receipt of payment for the journey or location;
·
statement of account confirming the booking issued by the Organisation/Travel
Agency;
·
invoice from the Organisation/Travel Agency relative to the debited penalty;
·
copy of the cancelled ticket;
·
journey programme and regulations;
·
travel documents (visa, etc.);
·
journey booking contract.
Europ Assistance has the right to take over possession of the journey and/or
location deeds not used by the Insured party.
Limits and legal effects of all the services
In addition to the exclusions given for the individual services and/or
guarantees, the following general conditions are also valid:
1 The Insured
party frees from professional secrecy, regarding the injuries being part of this
Insurance, those doctors who examined or treated same party after or even before
the injury, towards Europ Assistance and/or any judges that may be given the
power to examine the injury itself.
2 All the services
and/or guarantees are not due for damage caused by or dependent on:
a)
war, earthquakes, atmospheric phenomena with characteristics of natural
calamity, phenomena of transmutation of the nucleus of the atom, radiation
caused by the artificial acceleration of atomic particles;
b)
strikes, revolutions, riots, social unrest, looting, acts of terrorism and
vandalism;
c)
fraud by the Insured party, including suicide or attempted suicide;
d)
automobile, motorbike or motorboat races and relative trials and training,
mountain climbing over rocks or glaciers, trampoline jumps with skis or water
skis, kite surfing, the use of bobsleighs or the practice of air sports in
general;
e)
alcohol or psychotropic drug abuse as well as the non therapeutic use of drugs
and hallucinogens.
The services are also not supplied in those countries where a declared or
factual state of belligerence exists.
3 Europ Assistance
cannot be held responsible for damage caused by the intervention of the
Authorities in the country in which assistance is given or resulting from any
other accidental and unpredictable circumstance.
4 Should the
Insured party not make use of one or more services and/or guarantees, Europ
Assistance does not have to provide compensation or alternative services of any
kind as compensation.
5 Each right
towards Europ Assistance is debarred within a period of one year from the date
of the damage that gave origins to the right to service and/or guarantee,
pursuant to art. 2952 of the Italian Civil Code.
6 The right to
assistance supplied by Europ Assistance is forfeited should the Insured party
not contact the Operative Centre when the damage occurs.
7 In partial
derogation of what is indicated in art. 1910 of the Italian Civil Code, the
Insured party that makes use of the services similar to the present ones, even
for mere compensation, as provided by contracts signed with another insurance
company, must inform of the damage all insuring companies and specifically to
Europ Assistance Italia S.p.A. within three days with the penalty of forfeiture.
In the case in which another company is activated, these services shall be
valid, within the limits and under the conditions indicated, exclusively to
reimburse the Insured party of possible greater costs charged to him by the
insurance company that issued the service.
8 Any requests for
information, for complaints or disputes the Insured party must refer directly to
Europ Assistance, it being understood that the Contractor is exempt from all and
any responsibility regarding the services of the insurance.
9 The policy is
regulated by Italian law. All disputes relative to the policy are subject to
Italian jurisdiction.
10 Provisions of law are
applied to anything not expressly disciplined herein.
11 Indemnities and
reimbursements are paid in
Europ Assistance Italia S.p.A.

In order to issue the guarantees indicated in the Policy, Europ Assistance must
process the data of the Insured party and for this purpose requires, in
compliance with Italian Legislative Decree 196/03 (Italian Corporation) your
permission. The Insured party therefore, by contacting or making someone else
contact the Operative Centre of Europ Assistance, freely gives their consent to
the processing of the personal data, both common and sensitive, as indicated in
the Data Processing information sheet.
